Article 1 – General
The following definitions apply in these terms and conditions:
I LOVE LATIN EVENTS:
Company under limited liability company Dstinctiv Group with its registered office in Leiderdorp, also trading under the name “I LOVE LATIN EVENTS”, registered in the Trade Register of the Chamber of Commerce under number 54590922.
Customer:
The (legal) person who buys a ticket for an Event.
Event:
An Event is understood to be a performance (for example of music) and / or other event organized by I LOVE LATIN EVENTS in which, among other things, a performance of any kind is performed.
Article 2 – Applicability
These general terms and conditions apply to every agreement that has been concluded in the context of a visit to an Event and the purchase of all entrance tickets / tickets therefor between the Client and I LOVE LATIN EVENTS. In addition, it does not matter how the agreement is concluded. This means that these general terms and conditions also apply if the agreement has been concluded via a (pre) sales organization / intermediary engaged by I LOVE LATIN EVENTS with regard to the relevant Event. These general terms and conditions also apply to anyone who attends / visits an Event without that person (in) directly entering into an agreement with I LOVE LATIN EVENTS. Therefore, in these general terms and conditions for “Customer” it must also be read that a person attends / visits an Event.
The applicability of possible general terms and conditions of the Customer is expressly rejected by I LOVE LATIN EVENTS.
Article 3 – Entry ticket
Access to the Event is only granted on presentation of a valid and undamaged entrance ticket. The client is obliged to show the admission ticket at the request of or on behalf of I LOVE LATIN EVENTS and / or the operator of the place, building or site where the Event is held.
An admission ticket is provided to the Customer once and gives access to the Event once. If the Client leaves after entering the location where the Event takes place, the admission ticket is no longer valid.
An admission ticket can be a document issued by or on behalf of I LOVE LATIN EVENTS or a unique code issued by or on behalf of I LOVE LATIN EVENTS.
The entrance tickets issued by or on behalf of I LOVE LATIN EVENTS are and remain the property of I LOVE LATIN EVENTS and are made available exclusively to the Customer.
The admission ticket entitles the holder to attend the Event. Only the holder of the admission ticket who first shows it at the start of the Event will have access to it. I LOVE LATIN EVENTS assumes that the holder of the admission ticket is also the person entitled to it (the Customer is). The Customer must ensure that he / she remains the holder of the admission ticket issued by, on behalf of or on behalf of I LOVE LATIN EVENTS.
I LOVE LATIN EVENTS is not liable for loss or damage of entrance tickets.
I LOVE LATIN EVENTS guarantees the validity of the admission ticket only if the admission ticket has been obtained through a sales method designated by I LOVE LATIN EVENTS. It is the Customer who must prove and prove that they have been met.
Article 6: 230p sub e of the Dutch Civil Code applies to admission tickets, therefore admission tickets cannot be returned against reimbursement of the purchase price of the admission ticket (s).
The customer is prohibited without the prior permission of I LOVE LATIN EVENTS to sell one or more admission tickets to third parties or to provide them or provide them to third parties directly or indirectly for commercial purposes.
I LOVE LATIN EVENTS reserves the possibility to personalize the entrance tickets (to be provided by name). If this is the case, the Customer must provide the information to be specified by I LOVE LATIN EVENTS. The Client will only be granted access to the Event if the name stated on the admission ticket corresponds to the name of the Client / visitor and the Client / visitor can properly identify himself in the opinion of I LOVE LATIN EVENTS. In other cases, access to the Event may be refused.
I LOVE LATIN EVENTS is not obliged to carry out valid entry tickets (further check). The Customer must ensure that he / she is and remains the holder of an admission ticket issued by I LOVE LATIN EVENTS or an (advance) sales intermediary engaged by it.
Article 4. Regulations
The client is required to cooperate in order to be searched.
The Client is obliged to comply with further regulations, house rules and / or changes thereto and instructions from I LOVE LATIN EVENTS, traffic controllers, the operators or owner of the place, building or site where the Event is held, the order staff, the fire brigade , the police, first aid personnel and other authorized persons, whether or not further specified by I LOVE LATIN EVENTS.
The Client is forbidden to bring glassware, plastic bottles, cans, fireworks, (fire) weapons and / or dangerous objects and / or alcoholic beverages to the place where the Event takes place. If I LOVE LATIN EVENTS takes such objects into custody for the duration of the Event, it accepts no liability in this regard. Items that are prohibited by law will be confiscated and will not be returned.
The Client is obliged, upon request, to identify itself both during the visit of an Event and when ordering the admission ticket to enable I LOVE LATIN EVENTS to comply with its legal obligations in the context of events, including the obligation to not provide alcohol to persons below the age limit set by the government.
5 The Client is not permitted to take (semi) professional photo, film and other recording equipment to the location of an Event. Should I LOVE LATIN EVENTS hold such equipment for the duration of the Event, it accepts no liability for this. Whether (semi) professional recording equipment is involved will be assessed solely at the discretion of I LOVE LATIN EVENTS.
Registration of an Event in any form whatsoever, including photography, filming and making (other) audio and / or video recordings, is not permitted without the prior permission of I LOVE LATIN EVENTS, the same applies to the emphasis of and / or copy from the program (booklet), posters and other printed matter. Such registrations will be confiscated and destroyed without further ado.
The Client is not permitted to advertise or distribute from his / her own company (s) during an Event.
An Event is not suitable for people younger than 18 years, therefore only people of 18 years or older will have access to an Event. A Customer must be able to identify himself by means of a valid ID proof. If no valid ID proof is shown or if the Client has not yet reached the age of 18, the Client will be refused entry without I LOVE LATIN EVENTS being obliged to inform the Client of the purchase price of the admission ticket or any other amount of money that the Client has paid to obtain a ticket to be reimbursed.
It is forbidden to wear clothing with group characteristics such as but not limited to football shirts and clothing with political slogans and / or texts. In addition, (domestic) animals are prohibited. Furthermore, it is not permitted to smoke in tents and / or (temporary) buildings, with the exception of specially designated smoking areas.
An Event can only be paid with specially designated tokens / coins or cash
Article 5. Powers I LOVE LATIN EVENTS
I LOVE LATIN EVENTS is entitled to invalidate the admission ticket in the event of a breach of the obligations set out in these general terms and conditions. In addition, I LOVE LATIN EVENTS may refuse the Client access to an Event in which the Client is not entitled to a refund of the purchase price of the admission ticket (including the service costs) paid to I LOVE LATIN EVENTS or to a (pre) sales intermediary .
I LOVE LATIN EVENTS is authorized not to admit the Customer (anymore) to the Event and / or to remove (or have removed from) the place, site or building where the Event takes place in the event that I LOVE LATIN EVENTS is of the opinion that this is necessary for maintaining peace and order during the Event.
I LOVE LATIN EVENTS is authorized to make (or have made) video or audio recordings of the Event and therefore of all persons present at the Event and to use these recordings for any kind of promotional purposes. By obtaining the admission ticket and / or by entering the location where the Event takes place, the Customer explicitly and unconditionally agrees to making the aforementioned recordings without being entitled to any compensation of any kind.
Article 6. Program
I LOVE LATIN EVENTS tries as much as possible to implement the program in accordance with its announcement. I LOVE LATIN EVENTS is never liable for possible deviations from the program.
I LOVE LATIN EVENTS is not liable for a possible announced length of parts, possible cancellation or cancellation of parts of the program.
Article 7. Personal data
I LOVE LATIN EVENTS processes personal data of Customer and visitors to its website (s) in accordance with its privacy statement and in accordance with the General Data Protection Regulation and the General Data Protection Regulation Implementation Act. The privacy statement is available via website: www.ILOVELATIN.nl.
Article 8 Liability
Entering a place where an Event takes place as well as attending an Event is entirely at the Client’s own risk. This means that I LOVE LATIN EVENTS is not liable for damage caused as a result of the aforementioned entry or attendance.
I LOVE LATIN EVENTS is not liable for indirect damage, consequential damage, lost profit and / or missed savings incurred by the Customer. I LOVE LATIN EVENTS is only liable for direct damage suffered by the Customer and which is directly and exclusively the result of an I LOVE LATIN EVENTS attributable shortcoming. Insofar as I LOVE LATIN EVENTS is liable for any direct damage, this liability is limited to a maximum of the amount that is covered by its insurer.
I LOVE LATIN EVENTS is not liable for loss or theft of property of the Customer that took place during the Event.
Article 9 Force majeure
In the event of force majeure in the broadest sense of the word, including in this context also illness and / or cancellation of the artist (s), strikes, fire, bad weather, epidemics, failure of and damage to equipment and equipment for operating systems , sabotage, etc. I LOVE LATIN EVENTS has the right to postpone the Event to a later date or cancel the Event.
Only in the event of cancellation will I LOVE LATIN EVENTS be obliged to refund the purchase price of the admission ticket. This explicitly does not include the service costs that the Customer has paid through a (pre) sales intermediary. A refund will be made no later than twelve weeks after the canceled date via a (pre) sale address, after the customer has handed over to this (pre) sale address a valid and undamaged ticket for the (canceled) Event. Service costs or other damage will not be reimbursed. Neither can the Client claim (replacement) access to another Event.
Article 10 Applicable law and choice of forum
Dutch law applies to these terms and conditions.
Any disputes, of any nature whatsoever, that arise between a customer and I LOVE LATIN EVENTS as a result of (use or application of) these general terms and conditions and / or related agreements are exclusively submitted to the competent court in Utrecht.
